Translation of a Venezuelan criminal record certificate for Italian citizenship by residence

You already have apostilled Venezuelan criminal records for citizenship by residence: document order, validity and sworn translation into Italian.

If you already have your Venezuelan criminal-record certificate, correctly apostilled, and you need to file it in Italy for an application for Italian citizenship by residence, the next step may be preparing its translation into Italian in a form the procedure accepts.

This guide starts from the document you already hold. It distinguishes Apostille from translation, sets out the validity of the penal certificate, and explains where a sworn translation (*traduzione asseverata*) can fit. It is not a guide to obtaining the certificate in Venezuela or to apostilling it.

Note

What criminal-record certificate is required for Italian citizenship by residence?

Grant of citizenship by residence is governed, in particular, by article 9 of Italian Law no. 91 of 5 February 1992. Anyone living in Italy files the application online through the Italian Interior Ministry portal.

The Ministry lists, among the attachments, the birth record and the criminal-record certificate issued by the authorities of the country of origin. The operational instructions published by the Prefetture, updated 18 July 2025, refer to a criminal-record certificate of the country of origin, duly translated and legalised/apostilled under international or EU conventions.

Some Prefetture also specify third countries of residence. The Prefettura of Rome and the Prefettura of Reggio Emilia ask for the criminal-record certificate of the country of origin and of any other countries of residence, legalised and with a translation. That wording is not identical on every Prefettura page: read the competent office today.

In Venezuela the document is usually called a certificación de antecedentes penales (Ministerio del Poder Popular para Relaciones Interiores, Justicia y Paz). For Italy what matters is that it is an act issued by the authorities of the country of origin, in the format the portal and the Prefettura require.

This certificate is not the Italian Casellario Giudiziale. The Prefettura of Verona says so expressly: the foreign penal certificate is issued by the authorities of the country of origin. Do not replace it with an Italian Casellario.
Anyone with uninterrupted legal residence in Italy from before the age of 14 may, according to several Prefetture, not have to produce the penal certificate of the country of origin, and may instead file a substitute declaration. The Prefettura of Verona also requires that you have not resided in the country of origin or a third country for more than six months after turning 14. Examples: Reggio Emilia and Verona. Check your Prefettura: do not assume the exemption on your own.

Must the Venezuelan certificate be apostilled before it is translated?

Between Venezuela and Italy, for a Venezuelan public document intended for an Italian authority, the usual formality is the Apostille under the Hague Convention of 5 October 1961. Both States appear in the HCCH status table. The Ministerio del Poder Popular para Relaciones Exteriores recalls that, unless an exemption applies, a Venezuelan public document must be legalised or apostilled to take effect abroad.

An Apostille is not a translation. Under article 5 of the Convention, it attests the authenticity of the signature, the capacity of the signer and, where relevant, the identity of the seal. It does not certify that the criminal-record content is “true”, it does not correct data, and it does not renew the certificate’s date of issue.

When the translation is done in Italy, the flow consistent with the sources is: certificate already issued → Apostille in Venezuela on the document you already hold → translation of the specimen to be filed. Translating first risks leaving out sheets or files added later. ItaloDocs does not apostille in Venezuela.

Is there an electronic Apostille for Venezuelan criminal records?

Yes, for this type of act. The MPPRE states that in 2019 the electronic Apostille (e-App) was introduced for the Certificación de Antecedentes Penales issued by the Ministerio del Poder Popular para Relaciones Interiores, Justicia y Paz. The channel is the Sistema de Legalización y Apostilla Electrónica (SLAE).

The Embassy of Venezuela in Italy classifies criminal records, in the Apostille system, under category Legal and subcategory Judicial. The MPPRE also indicates an electronic register to validate paper and electronic Apostilles. That is enough to understand what document may arrive for translation (often the certificate plus an electronic Apostille). It is not a how-to. ItaloDocs does not operate the SLAE.

Why apostille before translating?

If the translation comes afterwards, the translator should work on the complete specimen that will be filed: certificate and Apostille, if that is the formality of the file. Apostilling after a translation is already closed can leave out the very sheets or files added later.

Can I translate my Venezuelan criminal record in Italy?

Yes: a foreign document you already hold, even if already apostilled, can be translated in Italy. Ministerial and Prefettura instructions ask for acts “translated in accordance with the law” or “duly translated”, without imposing a single geographic workshop.

The Italian Consulate General in Caracas describes a path in Venezuela: legalised document, Apostille of the Ministerio de Relaciones Exteriores, full translation into Italian (preferably by a translator known to the Consulate) and, if that route is used, consular notarisation of the translation. That is an admissible modality, not the only one. People already living in Italy often use asseverazione before an Italian court.

What is a sworn translation of a criminal-record certificate?

In Italy this is a traduzione asseverata (often also called a sworn translation): the translator attests, in the forms provided — usually in court — the correspondence between the source text and the Italian translation. The general picture is in when a sworn translation is needed.

  • the document you already hold is translated into Italian;
  • the translation must be faithful: it does not “improve” or align names or dates;
  • asseverazione attests that fidelity; it does not authenticate the signature on the original;
  • it does not replace the Apostille and does not change the certificate’s date of issue;
  • it does not guarantee that the Prefettura will accept the file.

Must the Apostille also be translated?

There is no single “always” or “never”. Prefetture ask for the certificate translated and apostilled/legalised; some pages speak of scanning the certificate together with the translation. If the specimen to be uploaded includes Apostille sheets or files, the translation may have to cover them. That is decided by the receiving authority, not by a blog.

How long is a criminal-record certificate valid?

The 18 July 2025 instructions state that the country-of-origin penal certificate is always valid for six months from the date of issuenot from the date of legalisation/Apostille nor from the translation. The Prefettura of Reggio Emilia and the Prefettura of Verona repeat the same rule.

An Apostille does not restart that period. The MPPRE even states that legalisation and Apostille, in themselves, do not expire: that is a different point from the validity Italy requires of the penal certificate. Do not apply birth-certificate rules (facts not subject to change) to criminal records.

What if my name or details do not match exactly?

Prefettura instructions ask you to enter data on the portal according to the foreign birth certificate and to align passport, identity card and residence permit. Where details diverge they may ask, depending on the case, for a foreign marriage certificate apostilled and translated, or a legalised consular certificate of concordance.

A second given name, two surnames, a different spelling or a place written another way is not “fixed” in translation. The translation reproduces the source. How to distinguish types of mismatch is in name, surname or date that do not match.

Can I send a PDF to request a quote?

Yes, for an ItaloDocs quote: a copy or PDF of the document you already have (certificate and, if present, Apostille) is enough to assess language and visible completeness. That does not mean the file is the final specimen of the application.

For asseverazione in Italy, the court office says which support to produce. For the citizenship portal, the Ministry and Prefetture ask for scans of already formed acts. A quote PDF does not automatically replace those requirements.

  2. Check that it is legible (every page or file).
  3. Check the date of issue against the six months indicated by the Prefetture.
  4. Complete the Apostille where it applies — before the final translation in Italy.
  5. Compare names, dates and places with the other documents; do not “correct” them in translation.

Do I need to apostille my Venezuelan criminal record before translating it?

When the translation is done in Italy, yes: that is the more consistent flow. Between Venezuela and Italy the Hague Apostille issued in Venezuela on the document you already hold usually applies. Translating first can omit sheets or files added later.

Can I have the translation done in Italy?

Yes. Court asseverazione is a modality used by people living in Italy. It is not the only one: the Consulate in Caracas also describes translation routes in Venezuela.

What is a sworn translation (asseverata)?

It is a translation whose conformity with the source is attested under Italian rules (usually in court). It does not replace the Apostille and does not correct the original.

Must the Apostille also be translated?

It depends on what the receiving body asks. If the specimen to be filed includes the Apostille, the translation may have to cover it. For a quote, send the complete document.

How long is a criminal-record certificate valid?

Prefettura instructions indicate six months from the date of issue, not from the Apostille or from the translation.

Does the Apostille renew the certificate’s validity?

No. The Apostille does not restart the six months. The MPPRE distinguishes the Apostille’s lack of expiry from the validity the destination country may require of the act.

Can I send a PDF to request a quote?

Yes: a copy or PDF of the document you already have can be enough to assess the translation. It is not proof that the file is enough for asseverazione or for the portal.

What if my details do not match?
