Foreign criminal records for Italian citizenship by marriage: which countries to check

The certificate of the country you live in now is rarely enough. Origin, citizenships, third countries, Prefettura vs consulate.

October 12, 2026 · 5 min

For citizenship by marriage (art. 5), Italian offices ask, in different ways, for criminal-record certificates covering origin, citizenships and residences. The certificate of the country you live in now, on its own, is usually not enough: the instructions may also require certificates from the country of origin, from citizenships you hold, or from previous residences. The exact list is set by the office handling your file.

ItaloDocs is a private service specialising in sworn translations. If you already hold the foreign criminal-record certificate, we can prepare the Italian translation. The record request and the citizenship application remain official channels; the exact rules are set by the authority competent for your file.

Marriage and residence: different lists

Art. 5 (marriage) and art. 9 (residence) do not automatically share the same list. This guide covers criminal-record certificates for marriage. For the Venezuelan record in a residence file, see Venezuela criminal records. For Venezuelan documents in an art. 5 file: Venezuelan documents for citizenship by marriage.

Residence in Italy (Prefettura) and a consular application

The ministerial instructions for applications in Italy refer to the criminal-record certificate of the country of origin, translated and legalised/apostilled, valid for six months from the date of issue. The Prefettura of Rome, on marriage, also spells out third countries of residence.

The Consulate General in London, for anyone filing there, sets its own scope: origin, third countries of residence from the age of 14 for periods of more than six months, except Italy, plus countries of citizenship, with a specific exemption if you left the country of origin before the age of 14 without retaining that citizenship. The thresholds in the London consular instructions apply to applications filed at that post; a Prefettura in Italy may ask for different documents.

Examples (the office decides the list)

Nationality alone does not tell you every certificate. Someone born in Venezuela, who lived in Spain, then in the United States and now lives in Italy may need to consider several certificates: origin, any further citizenships, third countries of residence and, if the office asks, the Italian casellario. Age and length of stay are read from the instructions of the office that receives the application, not from those of another consulate.

These examples do not tell you which form to request in each country. They are there to remind you that origin, citizenships and previous residences can enter the list, in addition to the country where you live now. Typical mistakes (missing country, expired certificate): errors in documents and translations.

Formalities and translation

You usually obtain the certificate first, then add an Apostille or legalisation when required (or check whether an exemption applies, for example Regulation 2016/1191), and finally prepare the Italian translation. ItaloDocs can handle the sworn translation of the document you already have.

If you are filing from the UK, the London instructions are set out in citizenship by marriage UK. If you are filing in Italy: application, documents and residences.

Frequently asked questions

Is the certificate from the country I live in enough?

Only if the competent authority does not also ask for origin, other citizenships or third countries. Check the instructions of your office.

Should Italy be included among the “third countries”?

London, in the current wording, excludes Italy from that consular scope. A Prefettura may ask for casellario or pending charges under its own rules. The London Consulate instructions and those of a Prefettura do not automatically coincide.

Can I send certificates from several countries together?

Yes, for a single translation quote. Formalities (Apostille, issuer, validity) remain those of each country.

Does ItaloDocs obtain foreign criminal-record certificates?

The service starts once you already hold the certificate. We can prepare the sworn translation into Italian. The record is requested from the competent foreign authority.
