US marriage certificate and divorce judgment for use in Italy
US marriage certificate and divorce judgment: Apostille, sworn translation and when the file is treated as a court dossier.
October 20, 2026 · 4 min
A US marriage certificate and a divorce judgment / decree are two different objects, even when they arrive in the same file for use in Italy: transcription, civil-status annotation, citizenship, other procedures. This page keeps them together because they share a state Apostille (or a court channel, according to the issuer) and translation into Italian — without confusing a one-page marriage certificate with a court file of dozens of sheets.
The service
If you already hold the marriage certificate or the divorce judgment, we translate what you already have: a simple act in sworn form; an extensive judgment as a court file. Issuance and Apostille remain official channels in the United States.
Marriage: a certificate, not “the court file”
The marriage certificate is usually issued by the vital records office of the state (or county) of celebration. As with birth, the CDC lists issuers by state. Format, annotations and certified copies are not uniform. For use in Italy (transcription, citizenship, registry) the recipient usually wants the complete act, apostilled and translated.
Italian picture on transcription: marriage celebrated abroad. Art. 5 citizenship: documents and residences. US documents: US documents for Italy.
Divorce: judgment, decree, pages and annexes
A US divorce judgment or decree is a court act. It may be short or a file with findings, custody, property, the judge’s signature, certified copies from the clerk of court. For Italy it may be needed to annotate dissolution, for a civil-status procedure, or in a citizenship file if the instruction asks.
The general guide remains foreign divorce judgment. Here the US specifics matter: state/court issuer, competent Apostille, volume of the file. A marriage certificate is not treated as a judgment; a 40-page judgment is not a “simple document”.
Apostille
Italy and the United States apply the Hague Convention. A marriage certificate is as a rule a state document: Apostille of the issuing Secretary of State (USA.gov). A judgment may follow the same channel or court / state rules on certified copies to be apostilled. Do not assume a single federal desk.
| Act | Nature | ItaloDocs quote |
|---|---|---|
| Marriage certificate | Vital records, usually a few pages | Sworn translation |
| Short divorce judgment / decree | Court act, modest volume | Assessed on the file; may stay on ordinary translation |
| Extensive judgment / file | Many pages, annexes, certified copy | Judgments and court files |
Translation and swearing
For use in Italy: Italian translation of the complete specimen. MAECI concerns other circuits. Send full scans (margins, stamps, reverse, Apostille). Names and dates must stay consistent with birth and other acts: common errors.
Already have the US marriage certificate or judgment and, where it applies, the Apostille? Send the complete file: simple act or court file, according to volume.
Frequently asked questions
Are the marriage certificate and the judgment translated in the same way?
The language is Italian in both cases. The quote changes if the judgment is a file: it should be submitted as a judgment, not as a simple certificate.
Who apostilles these acts?
As a rule a state authority (Secretary of State), not the federal Office of Authentications. Check in the issuing state.
Is the judgment always needed to use the marriage in Italy?
No. It is needed if the civil status is dissolved or if the recipient asks for the annotation. A still-valid marriage is a different file.
Does ItaloDocs obtain a marriage certificate or divorce decree in the US?
The service starts once you already hold the document: we can prepare the sworn translation into Italian.
Can I send marriage, divorce and birth together?
Yes, for a single quote on the real file.
